BILLS OF LADING & CHARTERPARTIES

We advise clients on all claims arising under bills of lading including disputes concerning the incorporation of standard terms and conditions, delivery of cargo without presentation of bills of lading and loss of cargo or cargo damage claims such as infestation and shortage claims.

We advise on a wide range of charterparties from bareboat, voyage, time and specialist charterparties and handle all types of disputes arising including off-hire, laytime and demurrage, withdrawal and termination, re-delivery issues, speed and performance claims, unsafe port claims indemnity claims for damage to ship or cargo and Inter-Club Agreement issues.

  • Drafting various charterparties for use on in the offshore supply sector.
  • Acting for insurers of international pharma company in relation to subrogated claims arising under global policy of insurance following shipment of pharma products from Ireland by sea and air by in relation to issues arising from containerisation and temperature control, advising on liability of carriers, forwarders and inland transporters.
  • Acting for terminal operators defending cargo damage claim arising from cargo handling operations and alleged total loss of product. The Irish proceedings involve consideration of freight forwarding liability, liability arising from bailment and incorporation in a sub-bailment arrangement terms and conditions of carriage.
  • Providing expert evidence to English shipowners on the applicability of the Hague-Visby Rules on shipments from Ireland for purposes of Belgian Appeal court proceedings.
